Gov. Jan Brewer

Times Topics: Jan Brewer. ON Friday, Gov. Jan Brewer of Arizona signed a law — SB 1070 — that prohibits the harboring of illegal aliens and makes it a state crime for an alien to commit certain federal immigration crimes. It also requires police officers who, in the course of a traffic stop or other law-enforcement action, come to a “reasonable suspicion” that a person is an illegal alien verify the person’s immigration status with the federal government.

Predictably, groups that favor relaxed enforcement of immigration laws, including the American Civil Liberties Union and the Mexican American Legal Defense and Education Fund, insist the law is unconstitutional. Less predictably, President Obama declared it “misguided” and said the Justice Department would take a look.

Presumably, the government lawyers who do so will actually read the law, something its critics don’t seem to have done. The arguments we’ve heard against it either misrepresent its text or are otherwise inaccurate. As someone who helped draft the statute, I will rebut the major criticisms individually:

It is unfair to demand that aliens carry their documents with them. It is true that the Arizona law makes it a misdemeanor for an alien to fail to carry certain documents. “Now, suddenly, if you don’t have your papers ... you’re going to be harassed,” the president said. “That’s not the right way to go.” But since 1940, it has been a federal crime for aliens to fail to keep such registration documents with them. The Arizona law simply adds a state penalty to what was already a federal crime. Moreover, as anyone who has traveled abroad knows, other nations have similar documentation requirements.

“Reasonable suspicion” is a meaningless term that will permit police misconduct. Over the past four decades, federal courts have issued hundreds of opinions defining those two words. The Arizona law didn’t invent the concept: Precedents list the factors that can contribute to reasonable suspicion; when several are combined, the “totality of circumstances” that results may create reasonable suspicion that a crime has been committed.

For example, the Arizona law is most likely to come into play after a traffic stop. A police officer pulls a minivan over for speeding. A dozen passengers are crammed in. None has identification. The highway is a known alien-smuggling corridor. The driver is acting evasively. Those factors combine to create reasonable suspicion that the occupants are not in the country legally.

The law will allow police to engage in racial profiling. Actually, Section 2 provides that a law enforcement official “may not solely consider race, color or national origin” in making any stops or determining immigration status. In addition, all normal Fourth Amendment protections against profiling will continue to apply. In fact, the Arizona law actually reduces the likelihood of race-based harassment by compelling police officers to contact the federal government as soon as is practicable when they suspect a person is an illegal alien, as opposed to letting them make arrests on their own assessment.

It is unfair to demand that people carry a driver’s license. Arizona’s law does not require anyone, alien or otherwise, to carry a driver’s license. Rather, it gives any alien with a license a free pass if his immigration status is in doubt. Because Arizona allows only lawful residents to obtain licenses, an officer must presume that someone who produces one is legally in the country.

State governments aren’t allowed to get involved in immigration, which is a federal matter. While it is true that Washington holds primary authority in immigration, the Supreme Court since 1976 has recognized that states may enact laws to discourage illegal immigration without being pre-empted by federal law. As long as Congress hasn’t expressly forbidden the state law in question, the statute doesn’t conflict with federal law and Congress has not displaced all state laws from the field, it is permitted. That’s why Arizona’s 2007 law making it illegal to knowingly employ unauthorized aliens was sustained by the United States Court of Appeals for the Ninth Circuit.

In sum, the Arizona law hardly creates a police state. It takes a measured, reasonable step to give Arizona police officers another tool when they come into contact with illegal aliens during their normal law enforcement duties.

And it’s very necessary: Arizona is the ground zero of illegal immigration. Phoenix is the hub of human smuggling and the kidnapping capital of America, with more than 240 incidents reported in 2008. It’s no surprise that Arizona’s police associations favored the bill, along with 70 percent of Arizonans.

President Obama and the Beltway crowd feel these problems can be taken care of with “comprehensive immigration reform” — meaning amnesty and a few other new laws. But we already have plenty of federal immigration laws on the books, and the typical illegal alien is guilty of breaking many of them. What we need is for the executive branch to enforce the laws that we already have.

Unfortunately, the Obama administration has scaled back work-site enforcement and otherwise shown it does not consider immigration laws to be a high priority. Is it any wonder the Arizona Legislature, at the front line of the immigration issue, sees things differently?
Hooray for Arizona. Now, Gov. Brewer better switch to an independent party for now her decisions have made her an enemy of the federal government for going against their master plan. She has made the decisions they didn't have the guts to make. If you stand up for borders, language and culture you go against the Feds.

Columnist, Alan Caruba, wrote a recent article entitled, “A Whiff of Revolution,” in which he generally describes the people of the United States as being fed up and disgusted with federal politics. Caruba rightly compares the actions by the federal government (particularly under Obama) to the actions by Great Britain just before the America Revolution, stating that “[i]t is the antithesis of a nation of laws, a republic.” Caruba predicts that Americans will eventually take this matter of freedom back into their own hands once again:

“If, between now and the midterm elections, the President and Congress pass the Cap-and-Trade Act and an amnesty for illegal aliens, I SUSPECT THAT SOME AMERICANS MAY NOT BE CONTENT TO SIT BY WHILE STATES AND THE COURTS WORK THEIR WAY WITHIN THE CONSTITUTION. They will sense—and rightfully so—a despotism never before associated with the presidency.” (emphasis added)

Caruba makes some valid points in his article and accurately describes a feeling of revolution prevalent throughout the country. However, I believe that a more thoughtful analysis must be attributed to what a real and successful revolution will compose.

Be Careful How You Answer

Let me ask readers a question. What's more important: freedom and its undergirding principles, or the entity meant to protect it? A word of caution: be careful how you answer that question, because the way you answer marks your understanding (or lack thereof) of both freedom and the purpose of government.

Thomas Jefferson--and the rest of America's founders--believed that freedom was the principal possession, because liberty is a divine--not human--gift. Listen to Jefferson:

"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men." (Declaration of Independence)

Jefferson could not be clearer: America's founders desired a land in which men might live in liberty. By declaring independence from the government of Great Britain (and instituting new government), Jefferson, et al., did not intend to erect an idol (government) that men would worship. They created a mechanism designed to protect that which they considered to be their most precious possession: liberty. In other words, the government they created by the Constitution of 1787 was not the object; freedom's protection was the object.

Again, listen to Jefferson: "That to secure these rights, Governments are instituted among Men." In other words, government is not the end; it is the means. Government is not the goal; it is the vehicle used to reach the goal. Nowhere did Jefferson (and the rest of America's founders) express the sentiment that government, itself, was the objective. Listen to Jefferson once more:

"That whenever ANY FORM OF GOVERNMENT becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness." (Declaration) (Emphasis added.)

Jefferson is clear: people have a right to alter or abolish ANY FORM OF GOVERNMENT that becomes destructive to liberty. To America's founders, there was no such thing as a sacred cow when it came to government. Government had but one purpose: "to secure these rights." When ANY FORM of government stops protecting sacred, God-given liberties, it is the right and duty of people to do whatever they deem appropriate to secure their liberties--even to abolishing the government.

I am not one to mince words. We are standing on the doorstep at the Memorial to our Republic. The shadow of this great nation is waning and those who have gone before us are standing at attention as the flag draped casket of freedom sets on the horse drawn caisson winding through the streets of eternity. We are watching this tragic and solemn procession while the socialists, communists, leftists, drug dealers, porn kings, illegal aliens, corrupted corporate, pharmaceutical, and banking heads, abortionists and politicians snicker and gloat over their “victory.” We have patiently waited for someone to rescue us and talked this thing to its death. We have run out of time and options. If we have the will, we must now begin the resistance.

At a recent conference, I heard a valiant police trained pastor who specializes in occult crime lead our group through a discussion of EXACTLY why free America is referred to in the past tense. Much of it has to do with politics, treasonous acts of surrender to world forces by the vast majority of elected officials at every level of government. They have been bought off thousands of times and have done so to the complete degeneration of our republic system and the American people.
That alone, calls for a cleaning of the government—top to bottom. The literal handful of legislators across the land who have done the right thing during their tenure should also step aside and allow fresh patriot blood to populate the state and federal government. The same should happen in the judiciary—complete and without exception. Governors are pawns and must retire. Military leadership above the rank of full colonel should also step down. In order to flush this system, ALL elected and appointed positions should be vacated. That is my view. If local folks feel a few should return, that is their choice, but it must be VERY clear that business as usual is a one way ticket out of town. Sheriff’s, police administrators and state police commanders are in this same category. They are “yes” men to conspirators and are incredibly dangerous to moral, constitutional government.

The other side of this dark leadership cadre is the roughly 65 million Americans (200 million worldwide) who participate in some form of “New Age” religion and have sought, tolerated or looked the other way as cults of every kind and persuasion have lured good people to spiritual death. For those of you who do not accept that this is a spiritual battle of the highest order, then stop reading and do something else. Do NOT write and lecture me on the “inappropriate place” I have given this issue within these thoughts. You may hold your view, but understand you are part of the problem. You and the tens of millions of Americans who have chosen to abandon all reason, a selfless lifestyle, and a belief in Godly leadership that translates into trusted leadership. YOU are the reason we have the desolate White House dictatorship that we do, and an idol worshipping Congress that is CONSPIRING to end sovereign America and replace it with rulers that desire Babylon on the Potomac at any cost regardless of our dissent.

Update on Bay Bridge, scheduled to open in 2013. The cost has gone from an original estimate of $1.1 billion to $6.2 billion. The quality of the construction has had it problems also. They say it will stand up to any earthquake, but will it stand up to American construction and engineering. If they had left off the final part which they are starting now, the 'Self Anchored Suspensions' section and continued with the Sky way, they would have saved a ton of money and been finished now.

Here's the question asked in my September 2000 column titled "It's time to part company": "If one group of people prefers government control and management of people's lives and another prefers liberty and a desire to be left alone, should they be required to fight, antagonize one another, risk bloodshed and loss of life in order to impose their preferences, or should they be able to peaceably part company and go their separate ways?"

The problem our nation faces is very much like a marriage where one partner has broken, and has no intention of keeping, the marital vows. Of course, the marriage can remain intact as one party tries to impose his will on the other and engage in the deviousness of one-upsmanship. Rather than submission by one party or domestic violence, a more peaceable alternative is separation.

I believe we are nearing a point where there are enough irreconcilable differences between those Americans who want to control other Americans and those Americans who want to be left alone that separation is the only peaceable alternative. Just as in a marriage where vows are broken, our human-rights protections guaranteed by the U.S. Constitution have been grossly violated by a government instituted to protect them. The Democrat-controlled Washington is simply an escalation of a process that has been in full stride for at least two decades. There is no evidence that Americans who are responsible for and support constitutional abrogation have any intention of mending their ways.

You say, "Williams, what do you mean by constitutional abrogation?" Let's look at just some of the magnitude of the violations. Article I, Section 8, of our Constitution lists the activities for which Congress is authorized to tax and spend. Nowhere on that list is authority for Congress to tax and spend for: prescription drugs, Social Security, public education, farm subsidies, bank and business bailouts, food stamps and other activities that represent roughly two-thirds of the federal budget. Neither is there authority for congressional mandates to the states and people about how they may use their land, the speed at which they can drive, whether a library has wheelchair ramps and the gallons of water used per toilet flush. The list of congressional violations of both the letter and spirit of the Constitution is virtually without end. Our derelict Supreme Court has given Congress sanction to do anything upon which they can muster a majority vote.

James Madison, the acknowledged father of the Constitution, explained in Federalist Paper No. 45: "The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce. ... The powers reserved to the several States will extend to all the objects which in the ordinary course of affairs, concern the lives and liberties, and properties of the people, and the internal order, improvement and prosperity of the State."

Americans who wish to live free have several options. We can submit to those who have constitutional contempt and want to run our lives. We can resist, fight and risk bloodshed and death in an attempt to force America's tyrants to respect our liberties and human rights. We can seek a peaceful resolution of our irreconcilable differences by separating.

Some independence movements, such as our 1776 war with England and our 1861 War Between the States, have been violent, but they need not be. In 1905, Norway seceded from Sweden; Panama seceded from Colombia (1903), and West Virginia from Virginia (1863). Nonetheless, violent secession can lead to great friendships. England is probably our greatest ally.

The bottom-line question for all of us is: Should we part company or continue trying to forcibly impose our wills on one another? My preference is a restoration of the constitutional values of limited government that made us a great nation.

I used to say that America is going to Hell; but then realized one day that our nation has already gone to Hell. The United States is incredibly wicked today, spitting in God's face and disregarding the commandments of God's Word. The U.S. has become an obese, pleasure seeking, arrogant, angry, worldly, Godless, self-righteous, ungrateful, sick-minded society.

When a nation stoops so low spiritually that 4,000 precious human beings are slaughtered every day by abortion, that nation has already gone to hell. Young girls today, they just wanna have fun. Young girls today just wanna party. Today young girls wanna go to a nightclub and have open sex on the floor of the nightclub, and then put it on YouTube, and if they should get pregnant they want to throw the baby into a dumpster. That's the new America! No morals. No self-respect. No nation. No borders. No language. No culture. No responsibility. Now that's America today!

When a nation stoops so low spiritually that pornography is legalized and people are downloading it to their cellphones, that nation has already gone to hell. Sodom had no such evil inventions.

When a nation stoops so low spiritually that God's name is taken in vain in nearly every Hollywood movie produced, that nation has already gone to hell.

When a nation stoops so low spiritually that public school children are taught that they are animals, who evolved from stardust, that nation has already gone to hell.

By no other named may you be Saved. Jesus is the finished work. This is what separate Christianity from religion. Religions are man made. It's finished! All others are against the redemptive work of Christ. To all others, including my Muslim friends, it's finished. Mohammad in the 6th century was not needed. It was finished 600 years earlier. The Untold Story of Terri Schiavo

I cannot think of anything more dehumanizing or wicked than to DELIBERATELY starve another human being to death. No civilized person could allow even an animal to suffer such a horrible death, let alone a human being. This is wicked! It's hard to imagine that a mass murderer like John Wayne Gacy was humanely executed by lethal injection... no starvation... no hunger... no thirst... no dehydration... no suffering (but Terri Schiavo suffered all of those horrible atrocities). This is so wrong! What has the medical, legal and political system come to in America? An EEG was never done on Terri, nor did she ever have an MRI. Why? Where did Terri get all those broken bones? How did her ribs, ankle, hip and spine get fractured? Why hasn't there been a criminal investigation? Terri's family pleaded for her life, offering to care for her at their own expense, in their own home. Her husband refused their request even though he himself was awarded one million dollars for her care. He had also remarried. Judge Greer never met Terri, yet sentenced her to death. Why?

America is a wicked nation! Terri may have been incapacitated, but she was indeed responsive (and her family wanted to take care of her). Terri's only crime was not being able to feed herself. You simply do NOT torture people to death! Terri was as much alive as you or I. She laughed, she cried, she loved. Terri had no health problems. If Terri had been a terrorist, a dog or a murderer, she would have been protected by laws against such horrible torture. It is not surprising in a cruel society that aborts it's own children a million times per year that life has become so meaningless... what's one more life, right? There is an agenda behind all of this, a culture of death, and you are next America! What has being done to Terri Schiavo is a clear barometer of America's spiritual condition. We are a murderous nation! Woe unto America! Terri's death will not be in vain.
